As with all professions, it is expected that the dental surgeon not only has sufficient knowledge and expertise to administer treatment to the standards laid out by the General Dental council, but they are also capable of putting that knowledge into practice using the equipment and tools at their disposal.
What equipment errors may occur?
The dentist is ultimately responsible for all the equipment within his surgery. It is therefore essential that all tools meet health and safety standards, are in working order and are used appropriately without causing distress or harm to the patient. Equipment can include anything from the dentist’s chair to the scalpel and from the drill to an x-ray machine.
When would the Dentist’s professional expertise be in question?
The courts will take into consideration:
- Dental or general medical equipment which have not been in appropriate working order.
- Inappropriate use of tools which lead to distress during treatment, or unacceptable treatment outcomes
- Defective dental fittings which cause distress associated medical problems, or unacceptable presentation issues.
- Faulty implants
- When an inappropriate tool is used for a specific procedure
- Extensive force used with dental tools which causes unreasonable pain or harm to the patient.
